Article One (1): Definitions		المادة الأولى (١): التعريفات
A-	Wherever contained herein, the following terms and expressions shall have the meanings ascribed thereto unless the context otherwise requires:	يكون للكلمات والعبارات الآتية –أينما وردت في هذه اللائحة– المعاني المبينة أمام كل منها ما لم يقتض سياق النص خلاف ذلك:	أ-
1-	The Kingdom: The Kingdom of Saudi Arabia.	المملكة: المملكة العربية السعودية.	١-
2-	The Authority: Zakat, Tax and Customs Authority.	الهيئة: هيئة الزكاة والضريبة والجمارك.	٢-
3-	Regulations: Economic Substance Requirements Regulations of Special Economic Zones	اللائحة: لائحة المتطلبات الاقتصادية الفعلية للمناطق الاقتصادية الخاصة.	٣-
4-	The Governing Body: Economic Cities and Special Zones Authority.	الجهة المختصة: هيئة المدن والمناطق الاقتصادية الخاصة.	٤-
5-	The Statute: The statute of The Governing Body issued by the royal decree No. (A\19) dated 10\03\1431H, and any amendments thereto.	التنظيم: تنظيم الجهة المختصة، الصادر بموجب الأمر الملكي رقم (أ/١٩) وتاريخ ١٠ / ٣ / ١٤٣١هـ، وأي تعديلات تطرأ عليه.	٥-
6-	The Zone: King Abdullah Economic City’s Special Economic Zone, Ras Al-Khair Special Economic Zone, Jazan Special Economic Zone, and Cloud Computing Special Economic Zone established pursuant to Council of Ministers Resolution No. (233) dated 29/3/1444H..	المنطقة: المنطقة الاقتصادية الخاصة بمدينة الملك عبدالله الاقتصادية، والمنطقة الاقتصادية الخاصة برأس الخير، والمنطقة الاقتصادية الخاصة بجازان، والمنطقة الاقتصادية الخاصة للحوسبة السحابية والمعلوماتية المنشأة بموجب قرار مجلس الوزراء رقم (٢٣٣) وتاريخ ٢٩ / ٣ / ١٤٤٤هـ.	٦-
7-	Exemptions and Incentives : The tax and customs exemptions and incentives available for the Licensed Entityin the Zone, as referred to in the Statute.	الإعفاءات والحوافز: الإعفاءات والحوافز الضريبية والجمركية المقدمة للمنشأة المرخصة في المنطقة على النحو المشار إليه في التنظيم.	٧-
8-	Qualified Activities: The activities that shall qualify for the exemptions, incentives, and exceptions approved for the Zone.	الأنشطة المؤهلة: الأنشطة المؤهلة للحصول على الإعفاءات والحوافز والاستثناءات المعتمدة للمنطقة.	٨-
9-	Licensed Entity: Any entity licensed to conduct activities in the Zone in accordance with the Regulations of the Special Economic Zones issued pursuant to Council of Ministers Resolution No. (468) dated 10/7/1447H.	المنشأة المرخصة: أي منشأة يرخص لها بممارسة الأنشطة في المنطقة بموجب اللوائح التنظيمية للمناطق الاقتصادية الخاصة، الصادرة بموجب قرار مجلس الوزراء رقم (٤٦٨) وتاريخ ١٠ / ٧ / ١٤٤٧هـ.	٩-
10-	Economic Substance Requirements: The requirements to be met by the Licensed Entityto verify that it carries out actual economic activities in the Zone, as prescribed in Article Three (3) of these Regulations.	المتطلبات الاقتصادية الفعلية: المتطلبات التي يجب استيفاؤها من قبل المنشأة المرخصة للتحقق من ممارستها لأنشطة اقتصادية فعلية في المنطقة، والمنصوص عليها ضمن المادة الثالثة (٣) من هذه اللائحة.	١٠-
11-	Intellectual Property Assets: any intellectual property rights, including copyright and related rights, patents, trademarks, industrial models, plant varieties and layout designs for integrated circuits.	أصول الملكية الفكرية: أي حقوق للملكية الفكرية وتشمل حق المؤلف والحقوق المجاورة وبراءات الاختراع والعلامات التجارية والنماذج الصناعية والأصناف النباتية والتصميمات التخطيطية للدارات المتكاملة.	١١-
12-	Financial Year: The accounting fiscal year of the Licensed Entity.	السنة المالية: السنة الضريبية للمنشأة المرخصة.	١٢-
B-	Notwithstanding Paragraph (A) of this Article, any term or expression used in these Regulations which is not defined in this Article shall be defined and interpreted according to the following reference in the order in which they appear:1- Legislations in force in the zone. 2- Zakat, Tax, and Customs laws in force in the Kingdom. 3- Legislations in force in the Kingdom.	فيما عدا ما نصت عليه الفقرة (أ) من هذه المادة، أي كلمة أو عبارة لم يرد لها تعريف محدد في هذه اللائحة يتم تعريفها وتفسيرها وفقا للمراجع الآتية وبحسب الترتيب الوارد ذكره:-١ التشريعات المعمول بها في المنطقة. -٢ الأنظمة الزكوية والضريبية والجمركية المعمول بها في المملكة. -٣ التشريعات المعمول بها في المملكة.	ب-
Article Two (2): Purpose of the Regulation		المادة الثانية (٢): الغرض من اللائحة
This Regulation are for the purpose of prescribing the Economic Substance Requirements to be met by the Licensed Entity in the Zone and its relevant provisions.		تهدف هذه اللائحة إلى تحديد المتطلبات الاقتصادية الفعلية التي يجب استيفاؤها من قبل المنشأة المرخصة في المنطقة والأحكام ذات الصلة.
Article Three (3): Scope of Application of the Regulation		المادة الثالثة (٣): نطاق سريان اللائحة
The Regulations shall apply to all Licensed Entities to carry out Qualified Activities in the Zone.		تسري اللائحة على كافة المنشآت المرخصة لممارسة الأنشطة المؤهلة في المنطقة.

 

Chapter Two: Economic Substance Requirements		الفصل الثاني: المتطلبات الاقتصادية الفعلية
Article Four (4): Economic Substance Requirements		المادة الرابعة (٤): المتطلبات الاقتصادية الفعلية
A-	The Licensed Entityshall meet the following Economic Substance Requirements every year, beginning from the first Financial Year in which the Qualified Activities are carried out:	على المنشأة المرخصة أن تستوفي المتطلبات الاقتصادية الفعلية الآتية بشكل سنوي، وذلك اعتبارا من أول سنة مالية تمارس فيها الأنشطة المؤهلة:	أ-
1-	The Licensed Entitymust have adequate premises and assets that are suitable for conducting his Qualified Activities in the Zone.	أن يكون لدى المنشأة المرخصة المكان المناسب والأصول المناسبة لممارسة الأنشطة المؤهلة في المنطقة.	١-
2-	The Licensed Entitymust employ an adequate number of full-time employees (who are physically present in the Zone) during the Financial Year, in proportion to the Qualified Activities, shall include personnel with an employment contract with companies contracting with the Licensed Entity.	أن يعمل لدى المنشأة المرخصة عدد كاف من الموظفين المتفرغين خلال السنة المالية (المتواجدين فعليا في المنطقة)، وذلك بما يتناسب مع الأنشطة المؤهلة، ويشمل ذلك الموظفين العاملين بمقتضى عقد توظيف لدى الشركات المتعاقدة مع المنشأة المرخصة.	٢-
3-	The Licensed Entitymust incur operational expenditures in the Zone, which shall be commensurate with the nature of the Qualified Activities carried out.	أن تتكبد المنشأة المرخصة مصاريف تشغيلية في المنطقة، بما يتناسب مع طبيعة الأنشطة المؤهلة التي يتم ممارستها.	٣-
4-	The Qualified Activities of the Licensed Entityshall be directed and managed from within the Zone, including:	أن يتم توجيه وإدارة الأنشطة المؤهلة التي تمارسها المنشأة المرخصة من داخل المنطقة، ويشمل ذلك ما يلي:	٤-
a-	Without prejudice subparagraph (1) of item (B) of this Article, The licensed Entity must have at least one of the directors responsible for managing the Qualified Activities residing in the Kingdom.	مع مراعاة ما ورد ضمن الفقرة الفرعية (١) من الفقرة (ب) من هذه المادة، يشترط أن يكون لدى المنشأة المرخصة مدير واحد -كحد أدنى- من المدراء القائمين على إدارة الأنشطة المؤهلة مقيما في المملكة.	أ-
b-	The management must have the necessary qualifications to manage the Qualified Activities.	أن يكون لدى القائمين على الإدارة المؤهلات اللازمة التي تمكنهم من إدارة الأنشطة المؤهلة.	ب-
c-	A number of board of directors’ meetings, or any equivalent board in accordance with the legal form of the Licensed Entity, should be held, during which actual and strategic decisions shall be made and recorded in the meeting minutes, in accordance with the Qualified Activities, provided that the quorum of members of the Board of Directors is reached for these meetings in the Kingdom.	عقد عدد من اجتماعات مجلس الإدارة، أو أي مجلس مماثل وفقا للكيان القانوني للمنشأة المرخصة، يتم من خلالها اتخاذ قرارات فعلية واستراتيجية تدون في محاضر، وذلك بما يتناسب مع الأنشطة المؤهلة، على أن يتم استيفاء النصاب النظامي لحضور أعضاء مجلس الإدارة لهذه الاجتماعات في المملكة.	ج-
B-	Without prejudice the requirements mentioned in paragraphs (A) of this Article, the Licensed Entitythat conducts intellectual property activities must satisfy the following additional requirements:	دون الإخلال بالمتطلبات المذكورة في الفقرة (أ) من هذه المادة، على المنشأة المرخصة التي تمارس أنشطة الملكية الفكرية أن تستوفي المتطلبات الإضافية الآتية:	ب-
1-	At least 50% of the directors managing the Qualified Activities must be residents of the Kingdom.	أن يكون خمسون في المائة (٥٠٪) على الأقل من المدراء القائمين على إدارة الأنشطة المؤهلة مقيمين في المملكة.	١-
2-	The Licensed Entitymust provide a detailed business plan demonstrating the commercial rationale for holding the Intellectual Property Assets in the Zone.	أن تقدم المنشأة المرخصة خطة عمل مفصلة توضح الأساس التجاري للاحتفاظ بأصول الملكية الفكرية في المنطقة.	٢-
3-	The Licensed Entitymust provide detailed employee information, including level of experience, type of contracts, qualifications, and duration of employment.	أن تقدم المنشأة المرخصة معلومات مفصلة عن العاملين لديها، بما في ذلك مستوى الخبرة ونوع العقود والمؤهلات ومدة التوظيف.	٣-
4-	Making strategic decisions and managing and bearing risks related to Intellectual Property Assets in The Zone.	أن تتخذ القرارات الاستراتيجية وإدارة وتحمل المخاطر المرتبطة بأصول الملكية الفكرية داخل المنطقة.	٤-
5-	The activity of the Licensed Entitymust not be limited to marketing Intellectual Property Assets.	ألا يقتصر نشاط المنشأة المرخصة على تسويق أصول الملكية الفكرية.	٥-
Article Five (5): Intellectual Property Activities		المادة الخامسة (٥): أنشطة الملكية الفكرية
1-	The intellectual property activities are considered within the Qualified Activities according to the classification issued from the Governing Body.	يعد نطاق أنشطة الملكية الفكرية ضمن الأنشطة المؤهلة وفقا لتصنيف الأنشطة المؤهلة الصادر عن الجهة المختصة.	١-
2-	Incentives and Exemptions are not applicable to income from intellectual property activities related to marketing intangibles.	لا يتم تطبيق الحوافز والإعفاءات على الدخل الناتج عن أنشطة الملكية الفكرية المتعلقة بتسويق أصول الملكية الفكرية.	٢-
3-	The Governor of the Authority may issue the necessary decisions for the implementation of the provisions of this Article.	لمحافظ الهيئة أن يصدر القرارات اللازمة لتنفيذ أحكام هذه المادة.	٣-

 

Chapter Three: Tax Procedures	الفصل الثالث: الإجراءات الضريبية
Article Six (6): Economic Substance Requirements Return	المادة السادسة (٦): إقرار المتطلبات الاقتصادية الفعلية
The Licensed Entitymust file an annual return using the prescribed form provided by the Authority and according to the procedures specified by it, for the purpose of verifying compliance with the Economic Substance Requirement.	على المنشأة المرخصة أن تقدم إقرارا سنويا باستخدام النموذج الذي تعده الهيئة وفقا للإجراءات المحددة من قبلها، وذلك للتحقق من استيفاء المتطلبات الاقتصادية الفعلية.

 

Chapter Four: Final Provisions	الفصل الرابع: أحكام ختامية
Article Seven (7): Penalties and Violations	المادة السابعة (٧): المخالفات والعقوبات
In the event of violation of any of Economic Substance Requirements, the penalties issued by the Governing Body shall be applied.	في حال مخالفة المنشأة المرخصة للمتطلبات الاقتصادية الفعلية، تطبق بهذا الشأن العقوبات الصادرة عن الجهة المختصة.
Article Eight (8): Guidance	المادة الثامنة (٨): الإرشادات
The Authority shall issue detailed guidance or explanatory material with respect to the provisions of this Regulations.	تصدر الهيئة إرشادات مفصلة أو مواد توضيحية فيما يتعلق بتطبيق أحكام هذه اللائحة.
Article Nine (9) :Effectiveness of the Regulation	المادة التاسعة (٩): سريان اللائحة
This Regulation shall be published in the Official Gazette, and deemed effective from the date of its publication.	تنشر هذه اللائحة في الجريدة الرسمية، وتعد نافذة من تاريخ نشرها.

بناء على المادة (السبعين) من النظام الأساسي للحكم، الصادر بالأمر الملكي رقم (أ / ٩٠) بتاريخ ٢٧ / ٨ / ١٤١٢هـ.

وبناء على المادة (العشرين) من نظام مجلس الوزراء، الصادر بالأمر الملكي رقم (أ / ١٣) بتاريخ ٣ / ٣ / ١٤١٤هـ.

وبناء على المادة (الثامنة عشرة) من نظام مجلس الشورى، الصادر بالأمر الملكي رقم (أ / ٩١) بتاريخ ٢٧ / ٨ / ١٤١٢هـ.

وبعد الاطلاع على قرار مجلس الشورى رقم (١٥١ / ١٢) بتاريخ ١٧ / ٦ / ١٤٤٧هـ.

وبعد الاطلاع على قرار مجلس الوزراء رقم (٧١٩) بتاريخ ٢١ / ٩ / ١٤٤٧هـ.

رسمنا بما هو آت

أولا

تعديل المادة (السابعة والعشرين) من نظام الاستثمار التعديني، الصادر بالمرسوم الملكي رقم (م / ١٤٠) بتاريخ ١٩ / ١٠ / ١٤٤١هـ، لتكون بالنص الآتي:

١‏- يكون لممثلي الوزارة المختصين صفة الضبط الإداري، ولهم دخول مواقع الرخص التعدينية بموجب النظام، للتفتيش، والمراقبة، وضبط المخالفات، والتأكد من تقيد المرخص له بأحكام النظام واللوائح وشروط الرخصة، وعلى المرخص له أن يتعاون مع ممثلي الوزارة بما يمكنهم من أداء مهماتهم على أكمل وجه.

٢‏- يكون لممثلي الوزارة المختصين ‏-المشار إليهم في الفقرة (١) من هذه المادة- ورجال السلطة العامة من موظفي الوزارات والأجهزة الحكومية الأخرى وكذلك الجهات الأمنية -الذين يمارسون أعمالا وفق الأنظمة الخاصة بهم لضبط المخالفات أو الجرائم المتصلة بها‏- صفة الضبط الجنائي عند اكتشافهم لأي من الجرائم المنصوص عليها في المادة (السادسة والخمسين مكرر) من النظام أثناء جولاتهم الميدانية في نطاق اختصاصهم المكاني، ولهم كذلك تلقي البلاغات لضبط تلك الجرائم.

٣‏- تقوم وزارة الداخلية بتوفير المساندة الأمنية لضبط الجرائم المشار إليها في هذه المادة عند طلب ذلك من أي من الجهات المشار إليها في الفقرة (٢) من هذه المادة.

٤‏- لرجال الضبط الجنائي ‏-المشار إليهم في هذه المادة‏- التحفظ على ما يتعلق بالجريمة من سجلات ووثائق وأدوات ومعدات وغير ذلك، ويكون ذلك على نفقة مرتكبها، ويتخذ المحقق ما يلزم نظاما حياله.

ثانيا

يعمل بالتعديل ‏-المشار إليه في البند (أولا)- بعد مضي (١٨٠) يوما من تاريخ النشر في الجريدة الرسمية.

ثالثا

على سمو رئيس مجلس الوزراء والوزراء ورؤساء الأجهزة المعنية المستقلة ‏-كل فيما يخصه‏- تنفيذ

المعتمدة بمحضر الاجتماع الأول للجنة المشتركة بين وزارة الصحة والهيئة العامة للغذاء والدواء في دورتها الثالثة المبني على قرار وزير الصحة رقم (٠٨٥١٦٨-٤٧-١٠١) وتاريخ ٢٧ /٩ /١٤٤٧هـ

المواد المخدرة

أولا

الجدول الأول يشمل المواد المخدرة وينقسم إلى خمس فئات على النحو التالي:

١‏- فئة (أ) تضم المواد المخدرة المدرجة في الجدول الأول لاتفاقية الأمم المتحدة لعام ١٩٦١م.

٢‏- فئة (ب) تضم المواد المخدرة المدرجة في الجدول الثاني لاتفاقية الأمم المتحدة لعام ١٩٦١م.

٣‏- فئة (ج) تضم المواد المخدرة المدرجة في الجدول الثالث لاتفاقية الأمم المتحدة لعام ١٩٦١م.

٤‏- فئة (د) تضم المواد المخدرة المدرجة في الجدول الرابع لاتفاقية الأمم المتحدة لعام ١٩٦١م.

٥‏- فئة (هـ) تضم المواد المخدرة المراقبة محليا بالمملكة العربية السعودية.

ثانيا

الفئات (أ، ب، ج، د) في الجدول الأول المذكورة أعلاه تعرف بالقائمة الصفراء والتي تصدر عن الهيئة الدولية لمراقبة المخدرات.

ثالثا

فئة (د) من الجدول الأول، يحظر استيرادها أو تصديرها أو إنتاجها أو صنعها أو استعمالها أو الاتجار بها أو توزيعها أو وصفها أو حيازتها بأي وسيلة كانت، ويقتصر استخدامها على الأبحاث الطبية والعلمية فقط بعد أخذ موافقة قطاع الدواء في الهيئة العامة للغذاء والدواء.

رابعا

المستحضرات الصيدلانية التي لا تخضع لنظام مكافحة المخدرات والمؤثرات العقلية ويكون أحد مكوناتها (٨) ملجم كوديين فأقل وبشكل صيدلاني أقراص أو كبسولات فقط، فإنها تكون من الأدوية التي تصرف بوصفة طبية ولا تطبق عليها الأحكام الواردة في نظام مكافحة المخدرات والمؤثرات العقلية، ولكن تطبق عليها الأحكام الواردة في نظام المنشآت والمستحضرات الصيدلانية ولائحته التنفيذية.

المؤثرات العقلية

أولا

الجدول الثاني يشمل المؤثرات العقلية وينقسم إلى خمس فئات على النحو التالي:

١‏- فئة (أ) تضم المؤثرات العقلية المدرجة في الجدول الأول لاتفاقية الأمم المتحدة لعام ١٩٧١م.

٢‏- فئة (ب) تضم المؤثرات العقلية المدرجة في الجدول الثاني لاتفاقية الأمم المتحدة لعام ١٩٧١م.

٣‏- فئة (ج) تضم المؤثرات العقلية المدرجة في الجدول الثالث لاتفاقية الأمم المتحدة لعام ١٩٧١م.

٤‏- فئة (د) تضم المؤثرات العقلية المدرجة في الجدول الرابع لاتفاقية الأمم المتحدة لعام ١٩٧١م.

٥‏- فئة (هـ) تضم المؤثرات العقلية المراقبة محليا بالمملكة العربية السعودية.

ثانيا

الفئات (أ، ب، ج، د) في الجدول الثاني المذكورة أعلاه تعرف بالقائمة الخضراء والتي تصدر عن الهيئة الدولية لمراقبة المخدرات.

ثالثا

فئة (أ) من الجدول الثاني، يحظر استيرادها أو تصديرها أو إنتاجها أو صنعها أو استعمالها أو الاتجار بها أو توزيعها أو وصفها أو حيازتها بأي وسيلة كانت، ويقتصر استخدامها على الأبحاث الطبية والعلمية فقط، بعد أخذ موافقة قطاع الدواء في الهيئة العامة للغذاء والدواء.

رابعا

المؤثرات العقلية التالية:

FENETYLLINE -١

METHAQUALONE -٢

SECOBARBITAL -٣

الواردة في الفئة (ب) من الجدول الثاني، يحظر استيرادها أو تصديرها أو إنتاجها أو صنعها أو استعمالها أو الاتجار بها أو توزيعها أو وصفها أو حيازتها بأي وسيلة كانت، ويقتصر استخدامها على الأبحاث الطبية والعلمية فقط، بعد أخذ موافقة قطاع الدواء في الهيئة العامة للغذاء والدواء.

خامسا

المؤثرات العقلية التالية:

EPHEDRINE -١

ETHANOL- ٢

NOREPHEDRINE -٣

الواردة في الفئة (هـ) من الجدول الثاني إذا كانت على شكل صيدلاني وللعلاج الطبي فإنها تخضع للرقابة وتطبق عليها الأحكام الواردة في نظام مكافحة المخدرات والمؤثرات العقلية، أما المستحضرات الصيدلانية التي يكون أحد مكوناتها إحدى هذه المواد فإنها لا تخضع للرقابة ولا تطبق عليها الأحكام الواردة في نظام مكافحة المخدرات والمؤثرات العقلية، ولكن يطبق عليها نظام المنشآت والمستحضرات الصيدلانية ولائحته التنفيذية.

وما عدا ذلك فتطبق عليها الأحكام الواردة في نظام إدارة المواد الكيميائية، الصادر بقرار مجلس الوزراء الموقر رقم (١٤٣) وتاريخ ١٤/‏٦‏/١٤٢٧ه، والمصادق عليه بالمرسوم الملكي الكريم رقم (م /٣٨) وتاريخ ١٦ /‏٦‏ /١٤٢٧هـ.

سادسا

المستحضرات الصيدلانية التي تحتوي على مادة مخدرة ومؤثر عقلي تعامل كمادة مخدرة.

سابعا

تعامل المواد القياسية التي تحتوي مواد مخدرة أو مؤثرات عقلية معاملة المادة التي تحتويها.

ثامنا

كواشف المواد المخدرة والمؤثرات العقلية، لا تخضع للرقابة ولا تطبق عليها الأحكام الواردة في نظام مكافحة المخدرات والمؤثرات العقلية، وتعامل معاملة الكواشف العادية ويكون فسحها عن طريق قطاع الأجهزة والمنتجات الطبية في الهيئة العامة للغذاء والدواء.

يحظر جلب أو استيراد أو تصدير أو إنتاج أو صنع أو استخلاص أو وصف أو تحويل أو استخراج أو حيازة أو إحراز أو بيع أو شراء أو توزيع أو تسليم أو تسلم أو نقل أو مقايضة أو تعاطي أو الوساطة أو تسهيل التعاطي أو إهداء أو تمويل أو تموين أي مركبات تحتوي علـى مادة الكانابيديول (Cannabidiol (CBD)) المستخلصة أو المستحضرة من مصادر عشبية بأي وسيلة كانت. ويستثنى من ذلك المركبات المصنعة كيميائيا بالكامل، شريطة أن تكون:

١‏- خالية من أي مكونات محتوية على مواد مخدرة أو مؤثرات عقلية مدرجة في الجداول وبأي نسبة كانت بدون استثناء ومنها مادة تتراهيدروكانابينول ((Tetrahydrocannabinol (THC).

٢‏- مثبتة بموجب تقارير تحليل صادرة عن مختبرات معتمدة لدى الهيئة، تظهر عدم احتواء المنتج علـى أي مادة مدرجة في الجداول، وذلك باستخدام طرق تحليلية معتمدة وذات حساسية كافية للكشف عن المركبات الدقيقة.

وتستثنى المستحضرات الصيدلانية المحتوية على مركبات تحتوي علـى مادة الكانابيديول (Cannabidiol (CBD)) المستخلصة أو المستحضرة من مصادر عشبية ذات الادعاء الطبي المعتمد، فتطبق عليها الأحكام الواردة في نظام مكافحة المخدرات والمؤثرات العقلية.

عاشرا

يحظر استيراد مادة Gamma-butyrolactone (GBL) أو تصديرها أو إنتاجها أو صنعها أو استعمالها أو الاتجار بها أو توزيعها أو وصفها أو حيازتها أو بيعها بأي وسيلة كانت، ويستثنى من ذلك:

١‏- المنتج النهائي المركب المعبأ والمعد للاستخدام ويكون أحد مكوناته مادة (GBL).

٢‏- الجهات المرخصة لأغراض علمية أو بحثية أو صناعية أو تجارية وتكون المادة أو المنتج خاضعا لنظام إدارة المواد الكيميائية.

السلائف الكيميائية:

الجدول الثالث يشمل السلائف الكيميائية وينقسم إلى فئتين على النحو التالي:

١‏- فئة (أ) تضم السلائف الكيميائية المدرجة في الجدول الأول لاتفاقية الأمم المتحدة لعام ١٩٨٨م.

٢‏- فئة (ب) تضم السلائف الكيميائية المدرجة في الجدول الثاني لاتفاقية الأمم المتحدة لعام ١٩٨٨م.

البذور والنباتات:

الجدول الرابع يشمل النباتات والبذور المحظورة وأي جزء منها وفي جميع أطوار نموها وعلى أي شكل كانت أو وجدت.
